1. Acceptance of Terms

By accessing and using MyRun.eu, you accept and agree to be bound by the terms and provision of this agreement.

2. Use License

Permission is granted to temporarily download one copy of the materials on MyRun.eu for personal, non-commercial transitory viewing only.

  • This is the grant of a license, not a transfer of title
  • Under this license you may not modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to reverse engineer any software contained on the website

3. Disclaimer

The materials on MyRun.eu are provided on an ‘as is’ basis. MyRun.eu makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4. Limitations

In no event shall MyRun.eu or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on MyRun.eu, even if MyRun.eu or an authorized representative has been notified orally or in writing of the possibility of such damage.

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

6. Data Processing Agreement

If you use MyRun as an event organizer to upload, manage, or share event photographs containing personal data, you act as a data controller and MyRun processes that data on your behalf. Our Data Processing Agreement is incorporated into and forms an integral part of these Terms and Conditions, and governs that processing in accordance with Article 28 GDPR.

7. Illegal Content, Reporting and Moderation (Digital Services Act)

MyRun hosts content uploaded by event organizers (photographs, logos, gallery materials). This section describes how we handle allegedly illegal content in accordance with Regulation (EU) 2022/2065 (the “Digital Services Act”, DSA).

7.1. Single point of contact. For communications concerning the DSA, including reports of illegal content and requests from competent authorities, MyRun can be contacted at [email protected] (subject: “DSA”). Notices and communications may be submitted in any language.

7.2. Reporting illegal content. Any person or entity may notify us of content on the platform they consider illegal (for example: infringement of copyright or trademarks, violation of image or privacy rights, defamatory content, or content prohibited by law). To allow efficient processing, the notice should include, as far as possible:

  • the reasons why the content is considered illegal (a sufficiently substantiated explanation);
  • the exact location of the content (URL of the gallery or photo, or a screenshot allowing identification);
  • the name and e-mail address of the person submitting the notice (except for offences related to sexual abuse material, where anonymous reporting is accepted);
  • a statement of good faith that the information provided is accurate and complete.

7.3. Processing of notices. We confirm receipt of the notice without undue delay where contact details are provided, and assess it in a timely, diligent, non-arbitrary and objective manner.

7.4. Measures. Following the assessment, MyRun may remove or restrict access to the content, suspend or terminate the account that published it, or take other measures permitted by law.

7.5. Statement of reasons. Where applicable, the user whose content is affected will be informed of the decision taken, the main reasons for it, and the possibility to contest it. The person who submitted the notice will also be informed of the outcome.

7.6. Contesting decisions. Decisions may be contested at [email protected] (subject: “DSA Appeal”), indicating the relevant elements. This is without prejudice to the right to bring the matter before the competent courts.

7.7. Content moderation. Apart from processing notices, MyRun does not carry out systematic content moderation: organizers control the content of their own galleries. Automatic processing (bib, face, and logo recognition) is used solely for photo search and organization, not for moderation decisions. Note: a request by a photographed person to remove their own photo is handled as a data-protection request (see the Privacy Policy and the Data Processing Agreement), not as a DSA notice, and can be addressed directly to the event organizer or to [email protected].

8. Revisions and Errata

The materials appearing on MyRun.eu could include technical, typographical, or photographic errors. MyRun.eu does not warrant that any of the materials on its website are accurate, complete, or current.
